serenity 		Yes, he can. Still the problem relies heavily on state law since, until recently (Obama said that gay couples do have visiting rights, since individuals are allowed to declare their closest relation, even if not bound by blood), the government has declared issue basically state issue by not making a definitive law or taking an official stance on issue. No matter what you can sue for discrimination cases under federal law, but(!) right now it`s tough for gay couples, it may not apply or a state law can overwrite it. My best advice is to consult lawyer (many give free consultations). I hope this helped & take care
