Research paper on legalization of gay marriage?

I`m doing a research paper in Government class in support of gay marriage. This is outline I made of reasons it should be legalized; Does this sound okay or is there anything incorrect?


Constitutional Reasons

1. Equal protection under the law as supported by the 14th Amendment

- Provides a broad definition of national citizenship
- Requires states to provide equal protection under the law to all persons within their jurisdictions
- Prohibiting gay people from marrying the partner of their choice is in conflict with Equal Protection Clause
- 1st section formally defines citizenship and requires states to provide civil rights
- 1st Amendment is separation of church and state, and state shouldn`t be imposing it`s religion upon the people. Therefore marriage should be up to people to decide, as long as it is done willingly


`No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within It`s jurisdiction the equal protection of laws. `

2. Full Faith and Credit Clause

- Addresses the duties that states within the US have to respect `public acts, records, and judicial proceedings` of other states - states have to recognize marriages performed by other states (should include gay marriage)

3; 9th Amendment

- Says people have rights not listed in the Constitution, meaning that we assume people have a lot, possibly unlimited number, of rights, and that being able to marry the person you love is 1 of them; In other words, trend in Constitution is toward assuming people have rights, not that they don`t

4. 1st Amendment

- Using religious argument to deny gay people right to marry is favoring 1 religious viewpoint over another, which is a violation of the Establishment Clause of 1st Amendment



Declaration of Independence

`All men are created equal` - this was said more than 20 years ago & still people are not equal; If you ban someone from marrying, you have to ban ALL people from marrying, not just those that some people don`t like.



Religious

1. Christian views on marriage typically regard it as instituted and ordained by God for the lifelong relationship between 1 man as husband and 1 woman as wife

2. Other churches perform ceremonies blessing same sex unions, but(!) do not refer to them as marriages. the Roman Catholic Church does not perform or recognise same-sex marriage; Whether to bless same-sex marriages and unions is a matter of debate within some denominations

3; Religion says that marriage should be between man & a woman, not government. Marriage is a religious idea. If America has always kept church and state separate, why should it stop at marriage?



Other Reasons

1. Do you think about your parents having sex? Probably not, so why do people concern themselves so much with gay people having sex?

2. Straight people can married by Elvis, aliens, or even in drive through in Vegas, so peoples` argument about marriage being a sacred and holy act between a man and woman is basically bullshit (wouldn`t use that word in essay) Sorry it`s a lot to read; and I noticed I wrote that the Establishment Clause is in the 14th Amendment and then I wrote that it`s in the 1st, which 1 is it?
